Terms and Conditons of Sale

1. General
These terms and conditions of sale apply to all goods supplied by UseMyNet.
No contract exists between the Customer and UseMyNet for the sale of any goods or services until UseMyNet has received and accepted your order and UseMyNet has received payment in full (in cleared funds). Once UseMyNet does so, there is a binding legal contract between us.

Goods are subject to availability.

All drawings, illustrations, product images are for illustrative purposes only may differ to the actual product.

2. Prices
Prices shown on UseMyNet's website at any time are believed to be current. If an error is found UseMyNet will inform you as soon as possible and offer you the option of confirming your order at the correct price, or canceling your order.
In addition to the price shown on htw website you may be required to pay;
Delivery charges which will shown within the shopping cart procedure if applicable.
Value Added Tax, Sales or other taxes. UseMyNet is not currently registered for VAT in the UK so VAT is not currently applied to order prices.

3. Payment
Payment for the goods and delivery charges are normally made through PayPal as our paymnet processor. Other payment methods are available. Contact us if required.
Payment is due before delivery.
Credit account invoices if allowed shall be payable by the Customer within 30 days of UseMyNet's invoice (unless otherwise agreed in writing by UseMyNet).

4. Delivery
Deliveries of physically shipped products will normally be desptched by next working day by an appropriate Royal Mail service or as otherwise specified.
The goods you order will be addressed to the delivery/shipping address given when you place your order.
Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, UseMyNet will not be liable for any loss or damage suffered by you through reasonable or unavoidable delays in delivery.
Time for delivery shall not be of the essence. The goods may be delivered by UseMyNet in advance of the quoted delivery date.
Upon receipt of your order you may be asked to sign for the goods received in good condition. If for any reason you are unable to check the contents of the package at time of delivery, please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty claims that you make thereafter.

5. Risk/Title
The goods are at your risk from the time of delivery

6. Your right of cancellation
You have the right to cancel the contract at any time up to the end of 7 working days after you receive the goods.
To exercise your right of cancellation, you must give written notice to UseMyNet by letter or via email, giving details of the goods ordered and any order reference. Notification by phone is not sufficient.
If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to UseMyNet at your own cost. The goods must be returned to the address provided. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.
Once you have notified UseMyNet that you are canceling the contract, UseMyNet will refund or re-credit you within 20 days from receipt of the returned goods for any sum that has been paid by you or debited from your credit card for the goods.
If you do not return the goods as required, UseMyNet may charge you a sum not exceeding the direct costs of recovering the goods.
UseMyNet may not be able to offer a full product refund for items returned that are not in a suitable condition.

7. Support
UseMyNet provide advice to support the operation of UseMyNet products sold to end users through this website for a minimum period of 12 months from the date of sale. UseMyNet continue to support products thereafter whilst still current but reserve the right to introduce an optional annual support fee of no more than 25% of the current list price of the products concerned. UseMyNet aim to respond to 90% of all new customer support requests within 1 working day and generally much sooner. Requests for support must be raised by email to support@usemynet.com. UseMyNet may provide support through a combination of email, telephone or remote administration sessions at it's discretion. Support will assume an appropriate minimum level of IT understanding, English language and control will be through PCs operating with the Windows XP or Windows 7 operating system. It's scope is limited to the use of UseMyNet for it's primary intended application and features.

8. Warranty
All goods supplied by UseMyNet are warranted free from defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.
This warranty does not apply to any defect in the goods arising from fair wear and tear, willful damage, accident, negligence by you or any third party, use otherwise than as recommended by UseMyNet, failure to follow UseMyNet's instructions, or any alteration or repair carried out without UseMyNet's approval.
If the goods supplied to you are damaged on delivery, you should notify UseMyNet in writing via the email address or fax number shown below within 48 hours.
If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify UseMyNet in writing via the email address or fax number shown below, as soon as possible, but in any event within 7 days of the date you discovered or ought to have discovered the damage, defect or complaint.

9. Limitation of Liability
Nothing in these conditions excludes or limits the liability of UseMyNet for death or personal injury caused by UseMyNet┬┤s negligence or fraudulent misrepresentation. Subject to this qualification, if you are a consumer UseMyNet shall not be liable to you for any loss or damage in circumstances where:
- there is no breach of a legal duty owed to you by UseMyNet or by its employees or agents;
- such loss or damage is not a reasonably foreseeable result of any such breach;
- any increase in loss or damage resulting from breach by you of any term of this contract.
If you are a business customer UseMyNet shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.

UseMyNet liability under this contract, except for death or personal injury caused by it's negligence or fradudlent misrepresentation, shall never exceed twice the sales value of the goods concerned.

10. Data Protection
UseMyNet will take reasonable precautions to keep the details of your order and payment secure.

11. Applicable Law
These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.

12. Our Right of Cancellation
Where we deem it necessary we may cancel the agreement at any time before the goods are delivered by giving notice to you. We shall promptly repay to you any sums paid by you or on your behalf under or in relation the agreement. We shall not be liable for any other loss or damage whatever arising from such cancellation.
